DR Congo: request RCCM records and use the ARSP directory

For official company documents, identify the competent commercial registry and GUCE office. The public ARSP directory provides a useful free supplementary search. It covers companies within the subcontracting regulator’s remit.

Choose the right register

The Ministry of Economy places RCCM registration within the justice system and identifies filing at the commercial court registry. GUCE centralises formation formalities. The national identification and tax numbers are described separately. Establish which identifier you have before starting a register enquiry. [1] [2]

Two directories with different purposes

The RCCM holds commercial registrations. ARSP regulates private-sector subcontracting. Its company list can provide RCCM identifiers and contact information. An absent ARSP result is not reliable evidence that a company lacks RCCM registration. [1] [4] [5]

Information and documents provided for

Article 46 of OHADA commercial law includes company name and legal form, activities and capital. It also provides for representatives and certain personally liable partners. Article 47 lists articles of association and further formation documents as file contents. An extract does not automatically contain the entire file. [6]

Third-party and overseas access

OHADA provides for third-party access to registry information. ARSP’s sector-directory search is free and requires no account. For a particular RCCM document, agree identity and representation requirements with the responsible registry. [6] [5]

Access to GUCE

The Ministry of Economy links to the Guichet Unique de Création d’Entreprise (GUCE) at guichetunique.cd. Use the ministry page to identify the responsible office. [1] [5]

Formation charges are not research fees

Official GUCE descriptions concern formation and its formalities. Free ARSP research is also distinct from registration charges or levies payable by a regulated business. [2] [1] [5]

Identify the responsible office

The ministry’s GUCE information link leads to its contact service. It lists info@economie.gouv.cd and +243 998 281 875. The address is the fifth floor of the government building, Place Royale, Boulevard du 30 Juin, Kinshasa-Gombe. Use this contact to clarify responsibility. [2] [3]

Avoid common mistakes

  • This guide concerns the Democratic Republic of the Congo, code CD. Do not confuse it with the Republic of the Congo, code CG. These authorities and directories belong to DR Congo. [1]
  • Expiry and publication dates in ARSP details belong to that record. Do not treat them as RCCM incorporation or deregistration dates without separate evidence. [5]
